TERMS OF PURCHASE
The Startup Stylist
By clicking “Buy Now,” “Purchase,” or any other phrase on the purchase button, entering your credit card information, or otherwise enrolling, electronically, verbally, or otherwise, you (“Client”) agree to be provided with products and/or courses by The Startup Stylist, acting on behalf of JDKZ Consulting, LLC (“Company”), and you are entering into a legally binding agreement with the Company, subject to the following terms and conditions:
1. TERMS
(a) Upon execution of this Agreement, electronically, verbally, or otherwise, the Coach agrees to provide services in accordance with The Startup Stylist (“Course”).
(b) The scope of services rendered by the Coach pursuant to this contract shall be solely limited to those contained therein and/or provided for on Coach’s website as part of the Course.
(c) Coach reserves the right to substitute services equal to or comparable to the Course for Client if reasonably required by prevailing circumstances.
(d) Client agrees to be open, present, and prepared to complete the work. Client is responsible for their own success and implementation of objectives met.
(e) The content included in the Course is for individual, non-commercial use. Client agrees not to share login details and/or Course materials with any third parties.
(f) Coach reserves the right to remove Client from the Course at any time for any reason.
(g) The Course includes the following:
8 modules delivered over 7 weeks, with live and pre-recorded content
Supporting templates, worksheets, and resources
Live Q&A and coaching during weekly sessions
Community access for interaction and support
2. METHODOLOGY
Client agrees to be open-minded to Coach’s methods and partake in services as proposed. Client understands that Coach has made no guarantees as to the outcome of the Course.
3. DISCLAIMERS
By participating in the Course, Client acknowledges that the Coach is not a medical doctor, psychologist, therapist, attorney, or financial advisor, and their services do not replace the care of other professionals. The information in this Course is not to be construed or substituted as psychological counseling or any other type of professional advice.
The Coach may provide information relating to products that might benefit the Client, but this is not an endorsement or recommendation. The Coach is not responsible for any adverse effects or consequences that may result, either directly or indirectly, from any information or teaching provided.
The Coach may also provide third-party recommendations for services such as marketing, photography, business, health, or other related services. Client agrees these are only recommendations, and the Coach is not liable for any services provided by third parties.
Any testimonials, earnings, or examples shown are examples only. There is no assurance of any particular outcome based on participation in the Course.
4. PAYMENT AND REFUND POLICY
(a) Upon execution of this Agreement, Client agrees to pay the full purchase amount.
(b) Coach does not offer refunds. The Startup Stylist is a 7-week program with 8 modules, released gradually to guide your progress step by step.
(c) If Client selects a payment plan, they agree to pay fees according to the schedule set forth at the time of purchase.
(d) Credit Card Authorization (if applicable): Coach may charge the credit card chosen by the Client.
(e) Failure to make payments may result in suspension of access until payment is made in full. Nonpayment after 14 days may result in termination of the Agreement.
5. INTELLECTUAL PROPERTY RIGHTS
All content, materials, templates, and other Course materials are the intellectual property of the Coach. Client receives a license for personal use only. Unauthorized sharing, distribution, or resale is prohibited and may result in removal from the Course without refund.
6. RECORDING AND REDISTRIBUTION OF CALLS
Client acknowledges that live group sessions may be recorded and used by the Coach for future commercial or educational purposes.
7. RELEASE
Client consents to being photographed, recorded, and/or referenced in Course materials, marketing, or other media for commercial or non-commercial purposes. Client waives any right to payment, royalties, or approval of use.
8. NON-DISPARAGEMENT
Both parties agree not to disparage the other publicly or privately in any form.
9. GOOD FAITH
Each party represents that they have acted and will continue to act in good faith in the execution and performance of this Agreement.
10. DISCLAIMER OF WARRANTIES
All Course materials and services are provided “as-is,” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
11. LIMITATION OF LIABILITY
Client accepts all risks arising from use of the Course. Coach is not liable for any direct, indirect, incidental, consequential, or exemplary damages arising from the use or misuse of the Course.
12. DISPUTE RESOLUTION
Any dispute not resolved by good-faith negotiation will be submitted to the American Arbitration Association. Arbitration shall occur within 90 days of the initial demand and may take place in Tallahassee, Florida, or via telephone. The arbitrator’s decision is final and binding.
13. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Florida, without regard to conflicts of law principles. Invalid provisions do not affect the remainder of the Agreement.
14. ENTIRE AGREEMENT
This Agreement contains the entire agreement between the parties and supersedes all prior agreements, written or oral.
